Our commitment

At DECATHLON CANADA INC. and its affiliated entities, including the DECATHLON GROUP* (hereinafter “DECATHLON”, “us”, “we” or “our”), your privacy is important to us. Accordingly, we are committed to regularly reviewing our practices to ensure that they are up to date and to ensure that effective controls are in place to protect the personal information you have entrusted us with. We will never sell or rent your personal information. *DECATHLON GROUP includes DECATHLON SE and its affiliated entities such as companies and subsidiaries owned directly or indirectly by DECATHLON GROUP, including DECATHLON CANADA INC.

Summary of Policy

The Privacy Policy (the “Policy”) explains how we collect, share, use and retain your personal information when you use our website, www.decathlon.ca or other affiliated Canadian websites (the “Websites”), our apps, our devices, when you call us, respond to our surveys, participate in our contests, draws or events, when you purchase our products or when you use our services (collectively, the “Products and Services”), either online or in person at one of our stores. It also describes the types of personal information we collect about you, what we collect it for, how we use it, how we protect it, and under what circumstances we share it with third parties.

In addition, the Policy describes the choices you can make in respect of how we use your personal information, and the different ways you can contact us should you wish to access, verify or update your contact information, change your privacy preferences, or ask us about our privacy practices.

Applicable laws and regulations

This Policy and the personal information processed by DECATHLON are subject to Canadian, provincial and federal privacy laws as well as the General Data Protection Regulations of the European Union, as applicable.

Consent

By accessing our Websites or using our Products and Services, online or in-store, you consent to the collection, use and disclosure of your personal information in accordance with this Policy. In some cases, your consent may be “implied”, meaning that your permission is presumed based on your action or inaction at the time of collection, use or sharing of your personal information. If you do not agree with the Policy, please refrain from using our Websites or Products and Services. In addition, the collection of some of your personal information in accordance with the Policy is mandatory for us to provide you with the Products and Services you have requested, such as home delivery or the maintenance and repair of a sporting goods; therefore, if you elect not to provide us with the necessary personal information, we may not be able to offer you these Products and Services.

Who is the policy for?

This Policy applies to anyone who communicates with or interacts with us, regardless of the means used, whether you are a customer or someone who visits our Websites, stores, warehouses and other premises or event sites. Our employees, consultants and job applicants are subject to a separate privacy policy.

This Policy does not apply to websites operated by third parties over which we have no control. If you follow a link to a third-party site, the privacy policy of that third-party site will apply. What is personal information?

Personal information is information about you that can be used to identify you, directly or indirectly.

Information that is anonymized and that cannot be directly or indirectly associated with you is not considered personal information. When information is anonymized, it means that it has been irreversibly modified to ensure that it cannot identify you either directly or indirectly.

How is your personal information collected?

We collect only the personal information necessary to achieve the purposes set out in this Policy.

Personal information you provide voluntarily

When you visit our Websites, enter a contest, sweepstakes, promotion, event, complete a survey, create an account on our Websites, use our Products and Services, apply for our Products and Services, or otherwise communicate or interact with us, we may ask you to volunteer personal information (such as your name, email address, shipping and billing address, phone number, and date of birth) so that we can facilitate communication with you, respond to your request, and provide you with the Products and Services you have requested.

A cookie is a small data file containing a unique identification number that identifies the browser on a visitor's mobile device or computer each time the visitor accesses our Websites (but does not necessarily identify the visitor).

When you access our Websites, we use cookies to automatically collect information about users, such as the Internet Protocol (IP) address that identifies the mobile device or computer, the IP address of the Internet service provider, the name and version of the Web browser, the date and time the user accesses the Websites, the Internet address from which the user directly accesses our Websites, the operating system used, the sections visited on our Websites, the pages and images viewed, and the documents displayed or downloaded from our Websites.

With your consent, if you enable these technologies or if applicable law allows us to do so, we will also use cookies that enable us to manage our Websites and Products and Services and to analyze how our Websites and Products and Services are used. They also allow us to better understand your interests and offer you a more personalized online browsing experience better suited to your needs. Access to our in-store WIFI network

When you use a mobile device in a store by enabling the WiFi network access setting or when you access our free WiFi network, we may collect your Media Access Control (MAC) address and location data. We may then use this data to conduct analyzes that allow us to assess customer movement in our stores and maximize the efficiency of store layout. If you do not want your device to be detected or your data to be used for this purpose, please disable the mobile network access setting on your phone and any other electronic device.

Phone records

When you interact with us by telephone, telephone conversations may be recorded for training and quality control purposes.

We will notify you in advance that a call may be recorded for these purposes.

Video Recordings

For security reasons, our stores and warehouses have CCTV cameras. In particular, we use these cameras to monitor the movement of people and inventory in our stores and to prevent theft and loss. The images collected are kept, on average, for only 90 days, except in special circumstances.

Why do we collect and use your personal information?

We use personal information collected about you for the following purposes:

Data Analysis

We may use de-identified user information, which does not directly identify users, to create general reports of information used to investigate trends and changes in user demographics of the Websites and our Products and Services. This de-identified information is used to administer the Websites, to better understand the interests of our users generally, and to improve the Websites.

Electronic communications

If you provide your e-mail address or phone number, we may occasionally send you commercial emails or text messages, including to inform you of our promotions, contests, surveys, important updates, or to offer you a new product or service. At any time, you can unsubscribe by using the means indicated in the message or by changing your preferences in the settings of your DECATHLON account.

Targeted advertising

Through the use of cookies, if you activate these cookies or where applicable law allows us to do so, we are able to offer you targeted advertising according to your interests and that better responds to your needs. When you view or interact with our Websites, cookies and pixels tell us which pages or sections you are interested in. Using this information, we may subsequently display advertising that suits your interests. When you click on one of these ads, we can also track the response rate of the campaign. Who can your personal information be shared with?

We may share your personal information with your consent or where required or permitted by applicable law. For example, we may share your personal information with our service providers for the purposes described in the Policy, with certain professionals when necessary to provide you with the Products and Services you have requested, and to facilitate the management of our activities and to provide you with better Products and Services, as described in more detail below.

Disclosure to DECATHLON’s affiliated entities

We may share your personal information with DECATHLON's affiliated entities in order to comply with applicable laws, regulations and requirements, to ensure that your information is consistent, accurate and up-to-date, and to improve the quality and relevance of the Products and Services that you receive. In addition, with your consent, we may share your personal information within DECATHLON's affiliated entities for statistical and analytical purposes and for any other purpose described in the Policy. Please rest assured that each of DECATHLON's affiliated entities has appropriate controls in place to ensure the protection of your personal information, compliance with this Policy, and compliance with applicable privacy laws, regulations and requirements.

Communication to our service providers or partners

We may also share your information with third-party suppliers, consultants, and other providers of Products and Services that we employ to perform tasks or render Products and Services on our behalf. These third parties include our payment processors, website analytics companies, business intelligence service providers, messaging service providers, and advertising partners.

Can your personal information be shared or transferred outside of your province, territory or Canada?

If we have not yet achieved the purposes associated with the collection of the personal information in question, we will delete information that is out of date, inaccurate, incomplete or no longer required. If you ask us to delete the rest of your personal information, we will no longer be able to offer you our Products and Services.

File a complaint

You can file a complaint if you feel we have mishandled your personal information. We invite you to contact us before you file a complaint. We will take the time to analyze your complaint and discuss how the situation can be resolved.

What are your choices about how you use your personal information?

How long is your personal information kept?

We have adopted policies and practices governing the retention and destruction of personal information in our possession or custody. We retain your personal information only for such a reasonable period of time as is necessary or relevant to the fulfillment of the purposes identified in the Policy, or as permitted or required by applicable law. Even if you've stopped doing business with us, we have to keep certain information because, among other reasons, the law requires it. When this information is no longer needed, it is destroyed or anonymized in accordance with applicable laws, so that it can no longer identify you, directly or indirectly. As part of the process of destroying information, we follow strict rules and also ensure that unauthorized persons do not have access to it.
